The Chiang Garage – Terms & Conditions
(Comprehensive Business Terms for Tours, Training, Rentals & Services)

These Terms & Conditions (“Terms”) apply to all services provided by The Chiang Garage Co., Ltd. including guided motorcycle tours, off-road/enduro training, motorcycle rentals, workshop services, events, and use of our facilities. By booking, participating, or entering our premises, you agree to these Terms.
1. Definitions

“Company” refers to The Chiang Garage Co., Ltd.
-
“Participant” / “Rider” / “Customer” refers to any person using the Company’s services.
-
“Tour” refers to any guided motorcycle tour.
-
“Training” refers to any motorcycle skills course or coaching.
-
“Rental Motorcycle” refers to any motorcycle provided by the Company for tours or training.
-
“Deposit” means the 10% booking amount required to secure a tour.
-
“Remaining Balance” means the total tour price minus the deposit.
-
“Premises” refers to The Chiang Garage location in Chiang Mai, Thailand.
2. Booking, Payments & Refunds
2.1 Deposit & Final Payment
-
A 10% non-refundable deposit is required at booking to secure your place and reserve your motorcycle.
-
The remaining balance is due 60 days before departure.
2.2 Late or Missing Payments
-
If the final balance is not paid by the 60-day deadline, the Company reserves the right to cancel the booking.
-
Cancellation fees will still apply.
2.3 Cancellation by Participant
Refunds are calculated on the remaining balance, not the deposit.
Notice Before DepartureRefund
91+ days - 50% refund of remaining balance
90–60 days - 25% refund of remaining balance
<60 days - No refund
If payment has not yet been made but the cancellation window applies, the above fees still apply.
2.4 Cancellation by Company
The Company may cancel a tour or service due to:

Natural disasters (flooding, landslides, storms)
-
Political instability, road closures, government restrictions
-
Safety concerns
-
Low participant numbers (minimums will be stated on tour pages)
In such cases:
-
Participants may choose a full refund OR transfer to another tour date.
-
The Company is not liable for non-refundable personal expenses such as flights, visas, or insurance.
3. Mandatory Travel Insurance
All participants must hold a valid insurance policy that includes:
-
Trip cancellation & interruption
-
Medical expenses, including motorcycle riding
-
Accident & emergency treatment
-
Medical evacuation & repatriation
Proof of insurance must be provided before the tour begins.
Failure to provide proof may result in the participant being excluded without refund.
4. Rider Requirements
To participate in any motorcycle tour or training, the Rider must:

Be at least 18 years old.
-
Hold a valid motorcycle license recognized in Thailand.
-
Have competent riding skills suitable for the tour or training level.
-
Wear appropriate safety gear, including:
-
Helmet (mandatory)
-
Riding boots
-
Gloves
-
Protective jacket/pants or body armour
-
-
Agree to follow guide instructions and safety briefings at all times.
The Company reserves the right to refuse participation to anyone deemed unsafe or under-skilled for the activity, without refund.
5. Health & Fitness Requirements
Participants must declare any medical condition that may affect their ability to ride safely.
This includes (but is not limited to):

Heart conditions
-
Epilepsy
-
Recent injuries
-
Medication that causes drowsiness
-
Mental health conditions affecting judgment or risk assessment
The Company may request a medical certificate if necessary.
Failure to declare relevant information waives the Company’s liability for resulting injury or loss.
6. Rider Conduct & Responsibilities
Participants agree to:
-
Ride safely, responsibly, and within their limits.
-
Follow all Thai traffic laws.
-
Respect the instructions of guides and trainers.
-
Not operate a motorcycle while under the influence of alcohol, drugs, or medication that impairs ability.
-
Respect local communities, cultures, and the environment.
The Company may remove any participant who behaves dangerously, abuses staff, damages property, or disrupts the group.
No refund will be given in such cases.
7. Motorcycle Use, Damage & Liability
7.1 Provided Motorcycles
Rental motorcycles are maintained professionally.
Participants must:

Inspect the motorcycle before departure.
-
Report any issues immediately.
-
Use the motorcycle only for tour/training activities.
7.2 Damage, Breakages & Responsibility
Participants are financially responsible for:
-
Crash damage
-
Parts broken due to impact or misuse
-
Bent or damaged handlebars, levers, footpegs, plastics, mirrors, etc.
-
Damage caused by riding beyond ability or ignoring guide instructions
-
Tyre or tube damage resulting from impact or off-route riding
A damage deposit (amount varies by motorcycle) may be required and is refundable if no damage occurs.
7.3 Mechanical Failures
If a mechanical issue arises through no fault of the rider:
-
The Company will repair or replace the motorcycle when possible.
-
Lost riding time due to unforeseeable mechanical issues does not qualify for compensation.
8. Risk Acknowledgment & Assumption of Liability
Motorcycling, especially off-road riding, involves inherent risk, including:
-
Falling
-
Collisions
-
Changing terrain conditions
-
Weather hazards
-
Mechanical failures
-
Injury or death
By participating, Riders acknowledge these risks and accept responsibility for:
-
Their riding decisions
-
Their physical capability
-
Using the motorcycle safely
-
Following guide instructions
The Company is not liable for:
-
Personal injury caused by rider error
-
Loss or damage to personal property
-
Delays caused by weather, road conditions, or third-party issues
Participants must sign a Liability Waiver & Indemnity Agreement before riding.
9. Itinerary & Route Changes
The Company reserves the right to modify routes, schedules, or accommodations due to:

Weather
-
Road closures
-
Safety concerns
-
Mechanical issues
-
Group capability
Such changes are made to protect participants and deliver the best possible experience.
No refunds are provided for itinerary adjustments.
10. Accommodation & Meals
Included services vary by tour.
Participants must:
-
Respect property rules
-
Pay for personal extras (minibar, laundry, damages)
-
Share rooms where required if booking a shared-accommodation tour
Special dietary needs should be communicated in advance.
11. Personal Belongings & Security
The Company is not responsible for:
-
Lost or stolen items
-
Damage to personal equipment
-
Loss during transport or activity
Riders are encouraged to use waterproof bags and keep valuables with them.
12. Use of Photos, Videos & Media
The Company may take photos or videos during tours and events for:
-
Marketing
-
Social media
-
Promotional materials
By participating, you grant the Company permission to use your likeness unless you notify us in writing before the tour.
13. Workshop Services & Repairs (On Premises)
When using The Chiang Garage’s workshop:
-
All repair work is undertaken at the customer’s request.
-
The Company is not responsible for hidden mechanical problems not visible during inspection.
-
Customers must collect their motorcycle within the communicated timeframe.
-
Storage fees may apply for uncollected motorcycles.
14. Cafe, Events & On-Site Facilities
Visitors to The Chiang Garage premises agree to:
-
Follow posted safety rules
-
Supervise children at all times
-
Use tools or equipment only with staff permission
Damage to property caused by negligence will be charged to the customer.
15. Complaints & Disputes
We aim to resolve all issues quickly and fairly.
If you have a complaint:
-
Report it to the guide or staff immediately.
-
If not resolved, submit a written complaint within 7 days.
All disputes fall under the jurisdiction of the Courts of Thailand.
16. Acceptance of Terms
By booking a tour, participating in training, renting a motorcycle, or entering our premises, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
